What is H1B Visa ? New Visa Reform Bill & How Indians are going to affect due to New Visa Reforms ?


Every Other Indian has a dream to go abroad and settle down there especially in United States where there is luxury lifestyle and high Standard of living.



But wait Recently in US parliament, The H1B Visa Reform Bill has been tabled by California Congresswoman Zoe Lofgren, a Democrat.

But What is H1B Visa?
  
     H1B Visa is a non-immigrant US Visa which allows Companies to employ Foreigners for a period of up to six years.The main focus to give this Visa is to help Companies to employ high skilled foreigners where they have been unable to find American employees. The minimum salary for an employee having H1B Visa is set as $60,000 per annum. Along with that H1B Visa holders are allowed to apply for permanent citizenship in United States as well as to buy and rent property in the country.


Why H1B Visa is Criticised in US?

     The main aim of this Visa was to supplement US Workforce with high skilled workers to do jobs that Americans are not skilled to do. But over time, there have been many protests that American companies use H1B Visa to replace American workers with the Foreign ones, as there is option to hire Americans at lower salaries without compromising on the skill sets. Due to this Visa the number of unemployed Americans have been increased.

What are New H1B Visa Reform Bill Proposed ?

     The new H1B Visa Reform Bill proposes to increase the minimum salary for visa holders to be $1,30,000, more than double the current minimum which is $60,000. This directly means that companies would either have to pay rather highly for the skilled workers or not choose Foreign employees in favour of American Citizens. This new Visa reform bill also eliminate the lowest pay category and raises the salary level for which H1B visa holders are free from non-displacement and recruitment attestation requirements to greater than $1,30,000.

How Indians are going to be Impacted by Proposed H1B Visa Reform Bill ?

     Indian IT Firms like Infosys, HCL, TCS, WIPRO, IGATE, Cognizant as well as global giants like IBM, Google , Accenture, Microsoft, Amazon and all are among the highest recipients of H1B Visas each year.
     If this bill passes in future, then the above companies have to bear significantly higher costs for employing highly skilled foreign citizens. Also for Small companies who cannot afford high costs to employ Skilled workers may even create a gap between demand and supply for talent.

Although US President Donald Trump has not spoken publicly about the new Visa reform bill yet keeping in mind that changes in H1B visa and other immigrant visas were among his campaign promises. And the thing is his wife and First lady Melania Trump came to US using H1B Visa in 1996. Now, let's see what happens next.
